On June 11, 1973, Gee was nominated by President
Richard Nixon to a seat on the
United States Court of Appeals for the Fifth Circuit vacated by Judge
Joe McDonald Ingraham. Gee was confirmed by the
United States Senate on July 13, 1973, and received his commission on July 18, 1973. Gee served in that capacity until his retirement from the bench on February 1, 1991. ==Post judicial service==
